July 2015: Federation of Polish Organisations in SA Inc – Alleged abuse of funds received under a contractual agreement The Ombudsman received an icac referral to determine whether the Federation of Polish Organizations of SA Inc abused funds received under a contractual agreement with the Ministry of Communities and Social Inclusion. The Ombudsman found that the organization had committed dysfunctions in public administration within the meaning of Section 5.4 (a) (i) of the Independent Commissioner Against Corruption Act 2012. The Ombudsman investigated a case brought by the independent anti-corruption commissioner concerning the behaviour of the former CEO of the city of Onkaparinga. The allegations related to the CEO`s participation in a conference in Brisbane in October 2016 on the partial costs of a corporate software company. At the time of the conference, the city council questioned whether it should buy company software marketed by the company. The investigation concluded that the company`s acceptance of the donation of conference registration, hotel accommodation and partial reimbursement of travel expenses by the company was contrary to the code of conduct that existed at the time for Council employees.

In this regard, the Ombudsman found that a fair lay observer could reasonably have recognized that the gift accepted by the CEO should influence how he would carry out his public duty. The Ombudsman found that the violation of the code of conduct committed by the CEO constituted a fault in the public administration and was also contrary to the law within the meaning of the Ombudsman Act 1972. November 2017: Coober Pedy District Council – Non-declaration of conflict of interest The Mediator received a referral from the Commissioner on Cr Paul Reynolds` alleged failure to declare that he was interested in the coober Pedy District Council`s decision to execute an energy development (EDL) purchase contract. It was alleged that Cr Reynolds had an interest in the case arising from his ties to the Coober Pedy Miners Association, Coober Pedy Gem Trade Show and Coober Pedy Opal Festival. The Coober Pedy Gem Show and the Coober Pedy Opal Festival are both expected to be sponsored annually by EDL for the duration of a new contract with the Council. The sponsorship contract was negotiated by the Coober Pedy Miners Association. Cr Reynolds did not express interest in the Commission`s review of the power purchase contract.

The Ombudsman conducted an investigation and found that Cr Reynolds was interested in the case, as he was a member of the board of directors of the Coober Pedy Gem Trade Show, which was hoping to obtain an indirect benefit based on the outcome of the case.
